公司不能提供提前30日的书面解除合同通知书，应被劳动仲裁机构视为违反劳动合同法。应裁决公司支付经济赔偿金。

弄不好能被判成主动辞职，赔偿金就不会有了。
不过似乎可以要求支付双倍工资，没有在劳动关系建立一个月签订劳动合同，自次月应支付双倍工资，可以索赔两个月的双倍工资。

没有签订劳动合同，应该赔偿双倍工资。
不过，如果公司这边做点手脚，倒是可能弄成员工自动离职。

1、A君离职当天办了哪些离职手续？有没有填写离职申请？
2、解除劳动合同证明的复印件？
3、A君在本案中主张了哪些权利？

劳动仲裁可能会以超过申请仲裁期限（60天）为由判定劳动者败诉！

“我国劳动法规定，提出仲裁要求的一方应当自劳动争议发生之日起六十日内向劳动争议仲裁委员会提出书面申请，仲裁委员会应在收到仲裁申请的六十日内作出仲裁裁决。劳动争议当事人对仲裁裁决不服的，可以自收到仲裁裁决书之日起十五日内向人民法院提出诉讼。对此，最高人民法院《关于审理劳动争议案件适用法律若干问题的解释》第三条作了补充规定，劳动争议仲裁委员会根据劳动法第八十二条规定，以当事人的仲裁申请超过60日期限为由作出不予受理的书面裁决、决定或者通知，当事人不服，依法向人民法院起诉的，人民法院应当受理。对确已超过仲裁申请期限，又无不可抗力或者其他正当理由的，人民法院依法驳回其诉讼请求。可见，劳动争议案件的申请仲裁时效至关重要，它不同于期间为两年的一般诉讼时效，它的申请仲裁期限只有自劳动争议发生之日起60日内。也就是说，在劳动争议发生之日起60日内，当事人未向仲裁机关申请仲裁，又无不可抗力或其他正当理由，就要承担败诉的法律后果。现实生活中，有许多劳动争议案件当事人因超过申请仲裁期限或因诉讼时无法提供不可抗力或其他正当理由而被判败诉。因此，笔者提醒广大劳动者在发生劳动争议后，一定要在申请仲裁期限内向仲裁机关提出书面申请，依法保护自己的合法权益。”<BR><BR>不过在本案中仲裁机构又受理了，有点搞不懂，期待楼主公布答案大家讨论。
