合同法第三十九条 劳动者有下列情形之一的,用人单位可以解除劳动合同:(二)严重违反用人单位的规章制度的;

  如果公司规章或合同中有明确说明违反计划生育政策属于严重违纪.是可以解除的.但前提是公司规章有经过合法程序.

你可以让他工作啊,但是工资你可以不支付,他请假期间的工资是有社保局支付,社保局是否支付是按照相关的规定执行,这与企业没有关系,
