终止合同

病假期间，与员工终止劳动合同，于情于法都不合适。
若该员工不适合岗位要求，不给请病假，提前一个月终止劳动合同。

       比较认同这种做法，也就是说在合同终止前几天该员工没有请病假可以视同已痊愈，不是在医疗期内终止合同，无需延迟三个月的医疗期后终止合同。
    此员工年假已休完，现在就尽量建议他先休几天病假，剩下的作为事假处理。

按照律师的建议，我们公司是这样处理的：终止劳动合同一般不需要提前通知，在终止前一天通知也可以的。根据他提供的病假证明，只是建议休息，你可以适当的批准几天，剩下的几天可以用让他休年假的方式。——千万要找劳动专业律师，各地的规定不一样，有的地方要求提前一个月通知的，有的地方则没有要求，具体到各地的规定来判断。关于病假这种事情，用人单位要完善规章制度，要有效制止员工利用这种方式逃避自己的义务。
