<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; LINE-HEIGHT: 150%; mso-pagination: widow-orphan"><SPAN lang=EN-US style="LINE-HEIGHT: 150%; FONT-FAMILY: 宋体; mso-bidi-font-size: 10.5pt; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体"><BR>5</SPAN><SPAN style="LINE-HEIGHT: 150%; FONT-FAMILY: 宋体; mso-bidi-font-size: 10.5pt; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">、年假如何休?<SPAN lang=EN-US><BR></SPAN>(<SPAN lang=EN-US>1</SPAN>)安排休假:单位根据生产、工作的具体情况,并考虑职工本人意愿,统筹安排职工年休假。<SPAN lang=EN-US><BR></SPAN>申请休假:即由员工申请休假,并由企业根据经营情况进行批准。<SPAN lang=EN-US><BR></SPAN>(<SPAN lang=EN-US>2</SPAN>)年休假在<SPAN lang=EN-US>1</SPAN>个年度内可以集中安排,也可以分段安排,一般不跨年度安排。单位因生产、工作特点确有必要跨年度安排职工年休假的,可以跨<SPAN lang=EN-US>1</SPAN>个年度安排。<SPAN lang=EN-US> <BR><BR></SPAN>此外,上述规定之外,大家还可以参见原劳动和社会保障部《企业职工带薪年休假实施办法》<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; LINE-HEIGHT: 150%; mso-pagination: widow-orphan"><SPAN lang=EN-US style="LINE-HEIGHT: 150%; FONT-FAMILY: 宋体; mso-bidi-font-size: 10.5pt; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体"><SPAN style="mso-spacerun: yes"></SPAN><BR>2009-05-30 20:03:00 </SPAN><SPAN style="LINE-HEIGHT: 150%; FONT-FAMILY: 宋体; mso-bidi-font-size: 10.5pt; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">张立德 律师<SPAN lang=EN-US><BR></SPAN><B style="mso-bidi-font-weight: normal"><SPAN style="COLOR: fuchsia">(二)产假、哺乳假</SPAN></B><SPAN lang=EN-US><BR>1</SPAN>、产假<SPAN lang=EN-US><BR></SPAN>(<SPAN lang=EN-US>1</SPAN>)法定产假:女员工生产的,可休产假<SPAN lang=EN-US>90</SPAN>天,其中产前假<SPAN lang=EN-US>15</SPAN>天;女员工难产的或剖腹产的,增加产假<SPAN lang=EN-US>15</SPAN>天;多胞胎生育的,每多生育一个婴儿,增加产假<SPAN lang=EN-US>15</SPAN>天。<SPAN lang=EN-US><BR></SPAN>女职工怀孕流产的,根据医务部门的证明,妊娠不满<SPAN lang=EN-US>4</SPAN>个月的,产假为<SPAN lang=EN-US>15</SPAN>天至<SPAN lang=EN-US>30</SPAN>天;妊娠<SPAN lang=EN-US>4</SPAN>个月以上的产假为<SPAN lang=EN-US>42</SPAN>天。<SPAN lang=EN-US><BR></SPAN>注意:上述产假,不论是否违反计划生育政策的生育,均得享有。<SPAN lang=EN-US> <BR><BR></SPAN>(<SPAN lang=EN-US>2</SPAN>)奖励假:女员工晚育的,增加奖励假<SPAN lang=EN-US>30</SPAN>天。如不享受奖励假的,则奖励假可以由其配偶享有。双方均不休奖励假的,按照女方一个月基本工资的标准给予奖励。<SPAN lang=EN-US><BR></SPAN>(<SPAN lang=EN-US>3</SPAN>)陪护假:男方奖励假<SPAN lang=EN-US> <BR></SPAN>此外,一些企业自行规定了<SPAN lang=EN-US>“</SPAN>陪护假<SPAN lang=EN-US>”</SPAN>,比如:男员工因配偶符合国家计划生育政策的怀孕生产,可享受<SPAN lang=EN-US>5</SPAN>天的陪护假。<SPAN lang=EN-US><BR></SPAN>(<SPAN lang=EN-US>4</SPAN>)产假的计算:包括公休日和法定节假日<SPAN lang=EN-US> <BR><BR>2</SPAN>、哺乳假<SPAN lang=EN-US><BR></SPAN>女员工自生育之日起,至婴儿一周岁期满之日止,依法享有哺乳假。<SPAN lang=EN-US><BR></SPAN>婴儿一周岁内,每天上、下午各给予哺乳时间半小时,家较远的女员工哺乳时间当天可以合并使用;多胞胎者,每多生育一个婴儿另增加半小时哺假期。<SPAN lang=EN-US><BR></SPAN>哺乳假未休不补,亦不可累计。<SPAN lang=EN-US><BR></SPAN>女员工哺乳超过批准的哺乳时间的,履行请假手续后,可按事假计算;未经批准而擅自延长哺乳时间的,视为旷工。 <SPAN lang=EN-US><BR><BR></SPAN><B style="mso-bidi-font-weight: normal"><SPAN style="COLOR: fuchsia">(三)丧假和探亲假</SPAN></B><SPAN lang=EN-US><BR>1</SPAN>、丧假<SPAN lang=EN-US><BR></SPAN>根据原国家劳动总局、财政部《关于国营企业职工请婚丧假和路程假问题的规定》<SPAN lang=EN-US>,</SPAN>国有企业职工的直系亲属死亡时<SPAN lang=EN-US>,</SPAN>企业应该根据具体情况<SPAN lang=EN-US>,</SPAN>酌情给予职工<SPAN lang=EN-US>1—3</SPAN>天的丧假。直系亲属包括父母、配偶和子女。如果职工死亡的直系亲属在外地<SPAN lang=EN-US>,</SPAN>需要职工本人去外地料理丧事的<SPAN lang=EN-US>,</SPAN>企业应该根据路程远近<SPAN lang=EN-US>,</SPAN>另外给予职工路程假。职工在休丧假和路程假期间<SPAN lang=EN-US>,</SPAN>企业均应当照常发放职工的工资。职工在途中的车船费等<SPAN lang=EN-US>,</SPAN>由职工本人自理。<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt; LINE-HEIGHT: 150%; mso-pagination: widow-orphan"><SPAN lang=EN-US style="LINE-HEIGHT: 150%; FONT-FAMILY: 宋体; mso-bidi-font-size: 10.5pt; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体"><BR>2</SPAN><SPAN style="LINE-HEIGHT: 150%; FONT-FAMILY: 宋体; mso-bidi-font-size: 10.5pt; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">、探亲假<SPAN lang=EN-US><BR></SPAN>《国务院关于职工探亲待遇的规定》(<SPAN lang=EN-US>1981</SPAN>年)<SPAN lang=EN-US><BR></SPAN>凡在国家机关、 人民团体和全民所有制企业、 事业单位工作满一年的固定职工,与配偶不住在一起,又不能在公休假日团聚的,可以享受本规定探望配偶的待遇;与父亲、母亲都不住在一起,又不能在公休假日团聚的,可以享受本规定探望父母的待遇。但是,职工与父亲或与母亲一方能够在公休假日团聚的,不能享受本规定探望父母的待遇。<SPAN lang=EN-US><BR></SPAN>职工探亲假期:<SPAN lang=EN-US><BR><BR>① </SPAN>职工探望配偶的,每年给予一方探亲假一次,假期为三十天。<SPAN lang=EN-US><BR><BR>② </SPAN>未婚职工探望父母,原则上每年给假一次,假期为二十天。如果因为工作需要,本单位当年不能给予假期,或者职工自愿两年探亲一次的,可以两年给假一次,假期为四十五天。<SPAN lang=EN-US><BR>③ </SPAN>已婚职工探望父母的,每四年给假一次,假期为二十天。<SPAN lang=EN-US><BR><BR></SPAN>探亲假期是指职工与配偶、父、母团聚的时间,另外,根据实际需要给予路程假。上述假期均包括公休假日和法定节日在内。<SPAN lang=EN-US> <BR><BR>3</SPAN>、非国有企业如何确定上述假期<SPAN lang=EN-US><BR></SPAN>参照上述规定在企业规章制度中确定即可。<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN></P>
