我个人认为是这样的:1、公司已经给了员工24个月的医疗期,已经做到位了,所以可以书面通知其医疗期到期,通知其办理退工手续,员工不愿意来办理的话,公司只要履行送达义务就不会有风险。
2、关于医疗补助费的规定是这样的,用人单位需要向劳动者支付医疗补助费的情形包括以下两种情形:第一种情形是指医疗期满解除,即用人单位依据《劳动合同法》第四十一条第一项(劳动者患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事由用人单位另行安排的工作)与劳动者解除劳动合同;第二种情形是指,医疗期满终止,即在劳动合同期满医疗补助费且医疗期也已届满时,用人单位不与劳动者续签劳动合同。所以你们要支付医疗补助费。
