2、收集几个不签订合同和社保结果有法律纠纷的真实案例,让他自己看。
3、让他签订相关的军令状(出了法律纠纷,该怎么办?谁负责?他能负全责吗?)

你所说的这个问题,属于人力资源管控的问题,在一家成熟的集团企业,会根据下属企业不同股权性质、不同发展阶段、不同行业特点等制定不同的管控方式。说实话,在未界定管控方式前,作为集团总部HR部门,如果直接通知分公司45岁以下人员签订合同、体检之类的,实属越权指挥。正常的做法是,在未明确集团与子公司权限之前,只通知总部相关人员执行,要求下属全资、控股公司依照执行,参股企业参照执行,经集团总裁签批后下发。

首先应该明确总公司对分公司的管控模式,然后再针对各业务模块明确具体的权责划分,做到有理有据,这样就不感觉越权指挥或是管的太细。如果没有明确这些,这个矛盾就无法解决。 我现在也遇到了这样的困惑,比如分公司人事招聘进度缓慢,人事主管对人事专员的管理不到位等我是直接问责人事主管合适还是分公司总经理合适?我想是不是先把这个问题弄明白了,才能明确权限怎么划分了?希望高人指点。
