应该需要的吧。离职补偿金指的是由于企业的过错,员工解除劳动合同(比如企业未及时支付劳动报酬,未依法为你交纳社会保险等等;企业证明员工不能胜任工作而与你解除合同;合同到期后企业不再与员工续签合同;企业裁员;企业破产、解散。
如果是劳动者自己辞职,用人单位是不需要支付经济补偿金的。现行法律规定只有在用人单位单方解除劳动合同时才需要支付经济补偿金。

不能吧因为林先生属于不能胜任工作,经培训或调整岗位后仍不能胜任工作
公司仅需提前30天书面告知劳动者本人,或者额外支付一个月工资后即可解除劳动合同

根据《劳动合同法》第四十条第二款,以及第四十六条第三款,依法该给6个月补偿金+1个月代通知金,这是肯定的。但林先生会不会被支持,我觉得关键要看所谓的协商,双方有没有签协议或者是书面证据证明。
如果没有,就是公司没有证据证明是协商了,公司就吃哑巴亏了;
如果有,林先生就难被支持了,除非林先生能证明协议是不知情情况下签的,或者是被强制签订的......

关键要看协商离职是谁先提出来的,如果是公司先提的,肯定是要给予6+1补偿的,或者是6.5+1(因为是6年多了,不足半年的计作0.5个月),如果是林先生先提出的,则公司不必支付补偿金,所以看双方的举证吧。回复:劳动纠纷案例之——协商离职是否还需补偿!
用人单位与劳动者就经济补偿金的给付标准自行达成的协议,如约定的给付标准低于法定标准,劳动者领取后,又在仲裁时效内主张权利,要求用人单位补足差额部分,应予以支持。但如果用人单位在协议中已明确告知劳动者相关法律或政策规定的标准,劳动者明确表示放弃权利,对其主张则不应予以支持。回复 7F beyondgu 的帖子

按照《劳动合同法》第三十六条规定,用人单位与劳动者协商一致,可以解除劳动合同。《劳动合同法》第四十六条第二款规定,“用人单位依照本法第三十六条规定向劳动者提出解除劳动合同并与劳动者协商一致解除劳动合同的,用人单位应当向劳动者支付经济补偿”。劳动合同法并未规定协议解除劳动合同应具备何种条件,只要双方当事人依法达成协议,便可提前终止劳动合同的效力,解除双方的劳动关系。从实践来看,协议解除具有以下特点:
(l)双方当事人具有平等的解除劳动合同请求权。劳动者或用人单位都可以主动向对方提出终止劳动合同关系的请求。
(2)必须经双方平等自愿协商一致而达成协议,才可以解除劳动合同,任何一方不能强加自己的意志于对方当事人。
(3)协议解除不受终止劳动合同条件的约束。
(4)由用人单位提出解除劳动合同的,必须依法向劳动者支付经济补偿金。由劳动者提出解除劳动合同,如给用人单位造成经济损失的,应该承担赔偿责任。
此种情况下,用人单位应根据劳动者在本单位工作年限,每满1年发给相当1个月工资的经济补偿金,最多不超过12个月。不满半年,按照半个月支付经济补偿金。本案中,林先生在某私营公司已经工作六年多了,由于并未明确是超过六年六个月还是低于六年六个月,因此本案中,林先生可能得到7+1的补偿也可能得到6.5+1的补偿标准。
