虽然是费了好大劲才看明白,你们和员工(保洁工)签的合同才三个月吗?这么短?应该是指试用期三个月吧?1、确定你们的合同期限,现在已规避三个月试用期的问题,(试用期:一年一个月,三年以内二个月,三年以上或无固定期限六个月)2、你们的合同是什么时候签的?规定必须在入职一个月这内;3、合同没有给员工一份是现在许多企业普遍存在的问题,劳动监察会让企业按规定办事;4、关于试用不合格,必须有正面的理由(不服从工作安排也算);

、 认定我们没有和他们2人签订劳动合同,劳动监察大队的说法是否成立?
合同成立是双方签字确认时,但最后还是得把原件一份给个人。

2、  我们已经快递了“解除劳动合同通知书”,是不是可以将2人就此做退工退保手续?
得查一下他们是否都签收了?拒收的话还得登报。
3、  此2人一直不过来办交接手续,那2人的工资是否可以暂缓发放?
工资是发现金还是打卡?若打卡的话,到发薪日我建议还是把该给的工资及时给发放。
4、  2人的《劳动手册》和《退工单》该怎么办?是快递给他们,还是一直放在单位,等他们自己过来拿?
我们不是一个地方的,所以你说的这些东西我不太了解。

这个问题有些严重啊,没有劳动合同万一出点什么状况只会越闹越大的,所以一定要把握好这件事情
