第一条、第二条要求都有点过了，劳动法也只是多付一个月工资，如果谈不笼，公司又实在要用他，则需要在合同书详细把公司规章制度、以后可能出现的工作失误问题，工作没出成绩的等各种问题贴上，如违反合同内容解聘，则不付任何违约金。如果公司没有任何原因就解聘则按人家要求去做。个人意见。
