style="font-family: 宋体;">认为,根据财政部、国家档案局《会计档案管理办法》(财会字(</span><span lang="EN-US"><font face="Times New Roman">1998</font></span><span style="font-family: 宋体;">)</span><span lang="EN-US"><font face="Times New Roman">32</font></span><span style="font-family: 宋体;">号)的规定,公司应当保管工资支付表等原始凭证</span><span lang="EN-US"><font face="Times New Roman">15</font></span><span style="font-family: 宋体;">公司对员工的提交的证据的真实性没有异议。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">经询问公司,</span><span lang="EN-US"><font face="Times New Roman">H</font></span><span style="font-family: 宋体;">所说基本属实(除了每天上班</span><span lang="EN-US"><font face="Times New Roman">9</font></span><span style="font-family: 宋体;">小时虚假,实际为</span><span lang="EN-US"><font face="Times New Roman">8</font></span><span style="font-family: 宋体;">小时),公司实行打卡上下班,上班打一次卡,下班打一次卡,但打卡记录无员工签字。每月工资发放采用现金方式,由员工签字。公司</span><span lang="EN-US"><font face="Times New Roman">08</font></span><span style="font-family: 宋体;">年前无带薪年休假的福利。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">初步判断:因员工所说的基本属实,故员工的第</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">项请求和第</span><span lang="EN-US"><font face="Times New Roman">5</font></span><span style="font-family: 宋体;">项请求,很难推翻。至于第</span><span lang="EN-US"><font face="Times New Roman">1</font></span><span style="font-family: 宋体;">项请求,超过了实践中</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年的期限,一般不会被支持。第</span><span lang="EN-US"><font face="Times New Roman">3</font></span><span style="font-family: 宋体;">项请求,因不明确其要求的是</span><span lang="EN-US"><font face="Times New Roman">2007</font></span><span style="font-family: 宋体;">年度还是</span><span lang="EN-US"><font face="Times New Roman">2008</font></span><span style="font-family: 宋体;">年度的年休假,如是</span><span lang="EN-US"><font face="Times New Roman">2007</font></span><span style="font-family: 宋体;">年度的年休假,则没有法律依据,</span><span lang="EN-US"><font face="Times New Roman">2008</font></span><span style="font-family: 宋体;">年度的年休假,则员工在</span><span lang="EN-US"><font face="Times New Roman">3</font></span><span style="font-family: 宋体;">月</span><span lang="EN-US"><font face="Times New Roman">15</font></span><span style="font-family: 宋体;">日已辞职,</span><span lang="EN-US"><font face="Times New Roman">2008</font></span><span style="font-family: 宋体;">年度未上班满</span><span lang="EN-US"><font face="Times New Roman">1</font></span><span style="font-family: 宋体;">年,依法也不应该支持。第</span><span lang="EN-US"><font face="Times New Roman">4</font></span><span style="font-family: 宋体;">项请求,应从</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">月</span><span lang="EN-US"><font face="Times New Roman">1</font></span><span style="font-family: 宋体;">日起支付双倍工资差额。当然,员工的上述</span><span lang="EN-US"><font face="Times New Roman">5</font></span><span style="font-family: 宋体;">项请求计算的金额基数过大,应该可以减少一些。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">本人要求公司提交</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年来的工资表、</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年来的考勤表、规章制度、民主制定程序及公示和培训的相关材料等与该员工相关的全部材料来,仔细分析里面有无可帮助公司的地方。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">公司认为,其可以提交</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年以来的工资表和</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年以来的日考勤明细以及规章制度及民主制定、公示和培训的相关材料,但认为,如果按真实地提交</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年以来的日考勤明细的话,那员工所称的周六及节假日加班基本上有事实依据了,故在电脑后台修改数据后,提供一份</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">年来无加班的日考勤明细出来。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">公司最终提交了工资表、日考勤明细、考勤及打卡制度、公司工会对考勤及打卡制度的回复以及规章制度的培训单出来。(需要说明的是:公司的考勤制度上面每周出勤为</span><span lang="EN-US"><font face="Times New Roman">6</font></span><span style="font-family: 宋体;">天,提交后修改为</span><span lang="EN-US"><font face="Times New Roman">5</font></span><span style="font-family: 宋体;">天,工会的回复也是后补的)</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">日考勤明细(用于证明</span><span lang="EN-US"><font face="Times New Roman">H</font></span><span style="font-family: style="font-family: 宋体;">小时,无加班)。审查意见:没有员工签字的电子考勤记录实践中如员工未确认,一般是不会采信的。(反正也没指望员工会承认,更不指望劳动仲裁会采信了)。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">考勤及打卡制度(证明制度规定,每天打卡时间为</span><span lang="EN-US"><font face="Times New Roman">8</font></span><span style="font-family: 宋体;">:</span><span style="font-family: 宋体;">无加班还缺乏关联性,也就是公司对</span><span lang="EN-US"><font face="Times New Roman">H</font></span><span style="font-family: 宋体;">的考勤是否严格执行了公司的制度,而这点还是主要看考勤表的。当然,其他能够证明</span><span lang="EN-US"><font face="Times New Roman">H</font></span><span style="font-family: 宋体;">某些考勤的其他材料也可以,如:请假条等。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">工资表(该公司的工资表是在印刷好的表格上人工填写的,其中印刷好的项目有:序号、级别、姓名、工作日数、基本工资、提成工资、应发合计、扣社保、扣伙食、罚款、扣款合计、实发金额、收款人签章。公司在工资表上序号栏人工填写</span><span lang="EN-US"><font face="Times New Roman">1</font></span><span style="font-family: 宋体;">、</span><span lang="EN-US"><font face="Times New Roman">2</font></span><span style="font-family: 宋体;">、</span><span lang="EN-US"><font face="Times New Roman">3……</font></span><span style="font-family: 宋体;">在级别栏填写了员工的所在部门市场一部</span><span lang="EN-US"><font face="Times New Roman">,</font></span><span style="font-family: 宋体;">姓名栏书写了员工的姓名</span><span lang="EN-US"><font face="Times New Roman">,</font></span><span style="font-family: 宋体;">工作日数栏未有填写,基本工资栏填写了员工的总工资数额,提成工资栏未有填写(由此可看出该公司的财务管理混乱,本应在基本工资栏填写</span><span lang="EN-US"><font face="Times New Roman">2500</font></span><span style="font-family: 宋体;">,在提成工资填写具体的提成工资数额的,但人家图省事,一栏填写搞定,也导致了每月在基本工资栏的填写数额都有变化),应发合计栏填写了和基本工资栏一样的数额,扣社保栏填写了具体的扣款数额,扣伙食栏和罚款栏未有填写,扣款合计栏填写了和扣社保栏一样的数额,实发金额栏填写了应发数额扣减去社保后的具体数字,收款人签章拦有</span><span lang="EN-US"><font 21pt;"><span style="font-family: 宋体;">公司提交的以上五份证据,要证明员工无加班的事实或已支付过加班费甚至于支付的工资中包括了加班费都很困难。看来只有另寻其他法子。</span></p><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;"><span style="font-size: 10.5pt; font-family: 宋体;">再次细看公司提交的证据,觉得工资表有一个对公司有利的漏洞可以钻,即在工资表中的工作日数未填写。遂要求公司回去之后让当时填写表格的工作人员找回填写表格当时那枝笔,在工作日数栏把具体的数字填写上,如:</span><span style="font-size: 10.5pt; font-family: 'Times New Roman';" lang="EN-US">22</span><span style="font-size: 10.5pt; font-family: 宋体;">、</span><span style="font-size: 10.5pt; font-family: 'Times New Roman';" lang="EN-US">21</span><span style="font-size: 10.5pt; font-family: 宋体;">等,该数字与修改过的无加班的日考勤明细表上的出勤天数要一致。由此来证明员工所称每周六和节假日必须上班,每月至少工作</span><span style="font-size: 10.5pt; font-family: 'Times New Roman';" lang="EN-US">26</span><span style="font-size: 10.5pt; font-family: 宋体;">天是虚假的。</span></span></p><span style="font-family: 宋体;"><span style="font-size: 10.5pt; font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">最终,公司提交了如下证据:工资表(证明每月的工资数额以及该月的出勤天数,由此得出员工无休息日和节假日加班)、日考勤明细(与工资表上的工作日数相符合,形成证据链条,并证明</span><span style="font-family: 宋体;">小时,周六和节假日也要求上班的。其代理律师进一步认为,该制度即使是真实的,但公司也不一定就执行该制度,没看见很多工厂跟员工在劳动合同中约定或规章制度中规定每天上班</span><span lang="EN-US"><font face="Times New Roman">8</font></span><span style="font-family: 宋体;">小时,但实际上却上</span><span lang="EN-US"><font face="Times New Roman">10</font></span><span style="font-family: 宋体;">多个小时的现象比比皆是。对工会的回复,认为是虚假的,是后补做出来的。对培训单(有</span><span lang="EN-US"><font face="Times New Roman">H</font></span><span style="font-family: 宋体;">的签字),认为无异议,但认为学习的规章制度不是公司提交出来的考勤及打卡制度。</span></p><span style="font-family: 宋体;"><br><p class="MsoNormal" style="margin: 0cm 0cm 0pt; text-indent: 21pt;"><span style="font-family: 宋体;">公司答辩称:</span><span lang="EN-US"><font face="Times New Roman">H</font></span><span style="font-family: 宋体;">的第</span><span lang="EN-US"><font face="Times New Roman">1</font></span><span style="font-family: 宋体;">项请求已超过两年的诉讼保护时效,并违反《深圳市员工工资支付条例》有关工资支付表仅保存两年的规定,第一项请求无法律依据,应驳回。第</span><span lang="EN-US"><font face="Times New 经验和教训:



1、回头看,当时又对某份关键证据进行加工了,该加工对仲裁庭处理员工的休息日和节假日的加班费起到关键的作用。现在想起来,很不应该,还是应该本着案件的本身面目去处理,最好的做法是输了案件买教训,之后只要单位规范起来就好了。

这个我们做HR的也没办法,要想吃饭,只得维护公司利益啊。

<P>刚结束一件三期女职工权益的事情。女职工W申请劳动仲裁,提出要求支付三期待遇、未签合同双倍工资差额、解除合同补偿金、加班费、补缴社会保险等请求。其中,劳动仲裁对补缴社会保险的请求作出终局裁决,责令补缴,其他请求在一审期间调解结案。</P>
<P>因调解的,故W与公司联系,要求支付相关款项,公司则提出,款项可以支付,但希望补缴社会保险就算了。W对此也同意了。</P>
<P>公司如果将款项支付给W了,一旦W反悔(毕竟之前双方闹得很不愉快),再去社保局要求补缴的,则员工的口头答应是没用的,即使员工书面声称其不再就社会保险的请求要求单位承担义务或放弃社会保险的请求,这样的放弃声明因违反了法律的强制性规定也是无效的。</P>
<P>那么公司应该怎么做才能尽可能的避免风险呢?[hide]本人要求员工出具一张收条:兹收到(2009)深*法民四初字第***号民事调解书的金额***元(转帐支付)和公司支付的社会保险补偿款***元。(该金额与单位应交的社保费用大抵相当,但单位并未支付该社保补偿款)<BR>本人的想法是这样子的:如果员工不追究的,则此事作罢;如果员工追究的,则拿出收条来,那么,社保部门会让员工先将公司支付的社保补偿款还回单位,再由单位补缴,如此一来,单位也不用额外增加成本。当然,因员工的离职补偿金等请求已经在一审期间调解结案了,即使员工去投诉补缴的,也不会再额外支付离职补偿金。[/hide]</P>
